Post-Divorce Document Requirements: Your Complete Checklist
Your divorce doesn’t end with the judge’s signature. Several important documents must be obtained, filed, or updated after finalization.
Immediate Post-Divorce Documents
1. Judgment of Divorce
The official court order ending your marriage. Court mails to both parties 2-6 weeks after judge signs. Keep at least 3 certified copies.
2. Certificate of Dissolution
State vital record of divorce. Request from NY State Department of Health or county clerk.
Financial Account Changes
3. QDRO (Qualified Domestic Relations Order)
Required for dividing 401(k), 403(b), or pension plans. Start process immediately after divorce.
4. Bank Account Documentation
Close joint accounts within 30 days. Both parties must sign closure forms.
5. Credit Card Changes
Close joint accounts. Request written confirmation. Monitor credit report.
Property Transfer Documents
6. Real Estate Deed Changes
Use quitclaim deed to transfer title. Must be notarized and filed with county clerk.
7. Vehicle Title Transfers
Complete MV-82 form. Submit to DMV with divorce judgment. Pay transfer fee.
Name Change Documents
Update in this order:
- Social Security card (Form SS-5)
- Driver’s license
- Passport
- Bank accounts and credit cards
- All other accounts
Beneficiary Updates
- Life insurance policies
- Retirement account beneficiaries
- Will and trust revisions
- Healthcare directives
- Powers of attorney
Timeline
- Within 1 Week: Request certified copies, close joint accounts
- Within 1 Month: Update Social Security, driver’s license, insurance, beneficiaries
- Within 3 Months: Property transfers, start QDRO, update will
- Within 6 Months: Finalize QDRO, complete refinancing
